Unfortunately, Belgian legislation does not state anything regarding paying for extra hours. So if your weekly hours exceed the maximum number of hours, the following rules apply:
- Als je 39 uur per week gewerkt hebt tijdens een volledig jaar bij dezelfde werkgever dan ontvang je 6 onbetaalde compensatiedagen.
- Als je 40 uur per week gewerkt hebt tijdens een volledig jaar bij dezelfde werkgever dan ontvang je 12 onbetaalde compensatiedagen.
- Je kan nooit het maximum van 40 uur per week overschrijden.
If you haven’t worked for a whole year for the same employer, you will receive one or two unpaid compensatory days for each 2 month period you have worked.
It is also important to know that you are allowed to work only one Sunday in every four, and if you always work on Sundays, you must be given a day off in compensation within the six days.
